First Stage

Eligibility Assessment for Collective Enfranchisement (flats and houses)

  • This service provides confirmation of whether Leaseholders qualify for purchasing the Freehold as a collective unit within the terms of the Leasehold Reform Act 1967, Leasehold Reform, Housing and Urban Development Act 1993 and the Commonhold and Leasehold Reform Act 2002. If you are not eligible, we will refund the charge less £5.00 administrative fee.

Second Stage

Initial Valuation of freehold asset (flats and houses)

  • This service provides a estimate of what the freehold interest of your flat or house is worth and gives you an idea as to how much you should be paying. You will receive a comprehensive Initial Valuation Report detailing what issues will affect the value of your freehold, such as Marriage Value and Hope Value. In the case of flats, this Valuation will be adjusted to reflect the number of flats in your building participating in the purchase. In the case of houses, you will receive an estimate of freehold value based on the Original Valuation Basis and the Special Valuation Basis.
  • The Valuation itself is based on the number of years remaining on your Lease, the current value of your flat and the Yield Rate and % Improvement in Value for your locality. These values were collated from determinations of the Leasehold Valuation Tribunal for areas throughout the United Kingdom.

Third Stage

Managing the enfranchisement process and setting up the Right to Enfranchise (RTE) Limited Company

Management of the process

  • This service includes:
  1. contacting all other Leaseholders to attract participation in buying the freehold.
  2. Drafting and distributing Participation Agreement to all leaseholders interested in purchasing the freehold.
  3. Establishing negotiation criteria as agreed by you in order to negotiate best purchase price without recourse to compulsory purchase legislation as per the Commonhold and Leasehold Reform Act 2002.
  4. Drafting and serving the Initial Notice upon the Freeholder and Managing Agent.
  5. Perusal of Counter-Notice if the Freeholder is unwilling to negotiate terms of purchase and to discuss with the Leaseholders the possibility of applying to the Leasehold Valuation Tribunal (LVT) to compulsorily purchase the Freehold.
  6. Providing updates to the Leaseholders throughout.

Setting up the Right to Enfranchise (RTE) Limited Company

  • This service also provides qualifying Leaseholders with a fully incorporated Enfranchisement Company Limited by Guarantee. The documentation which forms the Company, namely the Articles and Memorandum of Association are specialised to Enfranchisement Companies.
  • Also included in the fees are Companies House incorporation fees (for standard service), postage and all correspondence.

Fourth Stage

Legal work to transfer the Freehold to the Leaseholders

  • Service includes completion of all conveyancing documentation, forms, registration notices and all other legal work necessary to convey the Freehold property to the Leaseholders and complete the Collective Enfranchisement process.

Cost: £250.00 per flat plus Disbursements (typically £60.00 - £110.00 per flat)
